Terms and Conditions for Reciepie Mobile App

1. Introduction

Welcome to Reciepie! These Terms and Conditions ("Terms") govern your download, installation, access to, and use of theReciepie mobile application (the "App") and the services provided therein, including the generation of cooking recipes using artificial intelligence (collectively, the "Service"). The Service is provided by Igor Kirnosov s.p. ("we," "us," "our," or "Reciepie"). Our website ( https://reciepie.app ) provides related information, but these Terms specifically govern the App.

By downloading, installing, accessing, or using the App or Service, you ("User," "you," "your") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not download, install, access, or use the App or Service.

2. Service Description

Reciepie is a service, accessed via the App, that utilizes artificial intelligence, specifically Google Gemini, to generate cooking recipes based on user inputs or predefined parameters ("AI Content"). The Service aims to provide inspiration and assistance for meal planning and cooking.

3. Account Registration and Security

• Registration: To access certain features of the Service, you may need to register for an account. We use Clerk for user authentication and management within the App. You may register directly by providing your email address or by using third-party sign-in services like Google or Apple via their respective SDKs integrated into the App.
• Data Collection: During registration via Clerk, we collect only your email address. If you use Google or Apple Sign-in, these services may provide us with certain information (like your email address) according to their respective privacy policies and your settings with those services. Please review Clerk's, Google's, and Apple's privacy policies for more information.
• Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials (password, or access via Google/Apple) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
• Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4. Use of the Service

• License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install, access, and use the App and Service on a compatible device that you own or control, for your personal and commercial purposes, as further detailed regarding AI Content in Section 9.
• Acceptable Use: You agree not to use the Service:
  • For any unlawful purpose or in violation of any local, state, national, or international law.
  • To generate content that is harmful, infringing, defamatory, obscene, harassing, or otherwise objectionable.
  • To impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • To interfere with or disrupt the Service or servers or networks connected to the Service.
  • To attempt to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service.
  • To reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the App or the Service or the underlying AI (Google Gemini), except as may be permitted by applicable law.
  • To remove, circumvent, disable, damage or otherwise interfere with security-related features of the App or Service.

5. AI-Generated Content (Recipes)

• Nature of AI Content: You acknowledge that the recipes provided by the Service ("AI Content") are generated by an artificial intelligence (Google Gemini). While we strive for usefulness, AI Content may contain errors, inaccuracies, omissions, or may not be suitable for all dietary needs, skill levels, or available ingredients. AI is a developing technology and its output may be unpredictable or flawed.
• No Warranty on AI Content: We make no representations or warranties regarding the accuracy, completeness, reliability, safety, or suitability of any AI Content.
• User Responsibility: You are solely responsible for reviewing any recipe before use, ensuring the safety of ingredients and cooking methods, checking for potential allergens, and adapting recipes to your specific dietary requirements, cooking abilities, and intended use (including any commercial applications). You use all AI Content entirely at your own risk. Reciepie disclaims all liability for any adverse outcomes resulting from the use of AI Content, including but not limited to cooking failures, allergic reactions, injuries, or any issues arising from the commercial use, distribution, or sale of products based on the AI Content.

6. Payments, Subscriptions, Cancellations, and Refunds (via App Stores)

• Paid Features: Certain features, enhanced access levels, or usage quotas of the Service may require a purchase or subscription ("Paid Features" or "Premium Subscription"). Details of current Paid Features and their associated fees will be available within the App interface before purchase.
• Payment Processing via App Stores: All payments for Paid Features purchased through the App are processed directly by the platform provider (Apple App Store for iOS devices, Google Play Store for Android devices) ("App Store"). You must have a valid account and payment method with the respective App Store. By initiating a purchase within the App, you authorize the App Store to charge your registered payment method for the applicable fees. Your purchase will be subject to the App Store's applicable payment terms and conditions and privacy policy.We do not collect, receive, or store your full payment card details or other sensitive payment information.
• Fees: Fees for Paid Features are displayed within the App at the point of purchase, typically in your local currency as determined by the App Store. You are responsible for paying all applicable fees and taxes associated with your purchases. Fees are subject to change, but changes will typically be communicated by the App Store or us in advance of renewal.
• Subscriptions and Automatic Renewal: If Paid Features are offered on a subscription basis (e.g., monthly or annually), your subscription will automatically renew for successive periods of the same duration at the then-current price, unless cancelled by you.Subscription management, including auto-renewal settings, is handled directly through your App Store account settings (e.g., under 'Subscriptions' in iOS Settings or Google Play Store app). You authorize the App Store to charge your payment method for renewal fees.
• Cancellation: You may cancel your Premium Subscription at any time.To cancel, you MUST manage your subscription through your Apple App Store or Google Play Store account settings. Deleting the App does not automatically cancel your subscription. Instructions can usually be found on the respective App Store's support pages.
• Effect of Cancellation: If you cancel your Premium Subscription, the cancellation will become effective at the end of your current paid billing cycle (as managed by the App Store). You will retain access to the Paid Features associated with your subscription until the end of that period. After the billing period ends, your access to Paid Features will cease, and your account may revert to a free or basic tier if one exists.
• No Refunds from Us; App Store Policies Apply:All payments made through the App Stores are generally final and non-refundable by us (Reciepie). We do not provide refunds or credits for any partial subscription periods or unused features. Any refund requests must be directed to the respective App Store (Apple App Store or Google Play Store), which handles such requests according to their own refund policies. By purchasing Paid Features, you acknowledge and agree that refund eligibility is determined solely by the App Store's terms.

7. User Data and Privacy

Your privacy is important to us. Our collection and use of personal information in connection with the Service are described in our Privacy Policy. Key points relevant to these Terms include:

• We use Clerk to store your email address for account management.
• Payment processing is handled by the App Stores, not directly by us.
• If you opt-in, we use Resend (https://resend.com) to send you update emails. You can unsubscribe from these emails at any time by following the instructions in the email.
• We utilize various third-party services, including hosting and database providers (like Convex), AI providers (Google Gemini), authentication (Clerk, Google, Apple), and email delivery (Resend). Your interaction with these services and the App Stores are subject to their respective policies.

8. Third-Party Services

The Service integrates with or relies on various third-party services, including but not limited to:

• Clerk (Authentication)
• Google Sign-in / Apple Sign-in (Authentication via SDKs)
• Google Gemini (AI Recipe Generation via API)
• Apple App Store / Google Play Store (Payment Processing, Subscription Management)
• Resend (Optional Email Updates)
• Convex (Database Hosting)

Your use of these third-party services is subject to their respective terms and conditions and privacy policies. We are not responsible for the performance, content, or practices of these third-party services. Your interactions with Google Gemini are also subject to Google's applicable terms. Your purchases and subscriptions are subject to the terms of the respective App Store.

9. Intellectual Property

• Reciepie IP: The Service, including the App, its visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the Service ("Materials"), are protected by intellectual property and other laws. All Materials included in the Service are the property of Reciepie or its third-party licensors. Except as expressly authorized by us, you may not make use of the Materials.
• AI Content License: Subject to your compliance with these Terms and, critically, any applicable terms and restrictions imposed by our AI provider (Google Gemini), we grant you a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display the recipes generated specifically for you via the Service ("AI Content") for both personal and commercial purposes. This license is granted solely to you, the user who generated the specific AI Content via your account.
• AI Provider Terms & User Responsibility: You acknowledge that ownership and permitted uses of AI-generated output can be complex and are subject to the terms of service of the underlying AI provider (Google Gemini). It is your sole responsibility to ensure your use of the AI Content, particularly for any commercial purpose, complies with Google Gemini's terms and all applicable laws, regulations, and third-party rights (e.g., avoiding infringement if the AI inadvertently outputs copyrighted material). We make no warranty or representation regarding the permissibility of your intended use under Google Gemini's terms or applicable law.

10. Disclaimers

THE SERVICE AND ALL AI CONTENT AND MATERIALS AVAILABLE THROUGH THE SERVICE ARE PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED. Reciepie DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE SERVICE AND ALL AI CONTENT AND MATERIALS AVAILABLE THROUGH THE SERVICE, INCLUDING: (A) ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT; AND (B) ANY WARRANTY ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE.

Reciepie DOES NOT WARRANT THAT THE SERVICE OR ANY PORTION OF THE SERVICE (INCLUDING THE APP), OR ANY AI CONTENT OR MATERIALS OFFERED THROUGH THE SERVICE, WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND DOES NOT WARRANT THAT ANY OF THOSE ISSUES WILL BE CORRECTED. Reciepie SPECIFICALLY DISCLAIMS ANY WARRANTY REGARDING THE ACCURACY, SAFETY, COMPLETENESS, OR LEGALITY OF THE AI CONTENT.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SERVICE OR ReciepieENTITIES OR ANY MATERIALS OR CONTENT AVAILABLE THROUGH THE SERVICE WILL CREATE ANY WARRANTY REGARDING ANY OF THE Reciepie ENTITIES OR THE SERVICE THAT IS NOT EXPRESSLY STATED IN THESE TERMS. YOU ASSUME ALL RISK FOR ANY DAMAGE THAT MAY RESULT FROM YOUR USE OF OR ACCESS TO THE SERVICE, YOUR DEALING WITH ANY OTHER SERVICE USER, AND ANY MATERIALS OR AI CONTENT AVAILABLE THROUGH THE SERVICE. YOU UNDERSTAND AND AGREE THAT YOU USE THE SERVICE (INCLUDING THE APP), AND USE, ACCESS, DOWNLOAD, OR OTHERWISE OBTAIN MATERIALS OR AI CONTENT THROUGH THE SERVICE AND ANY ASSOCIATED SITES OR SERVICES, AT YOUR OWN DISCRETION AND RISK, AND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR PROPERTY (INCLUDING YOUR COMPUTER SYSTEM OR MOBILE DEVICE USED IN CONNECTION WITH THE SERVICE), OR THE LOSS OF DATA THAT RESULTS FROM THE USE OF THE SERVICE OR THE DOWNLOAD OR USE OF THAT MATERIAL OR CONTENT, AND FOR VERIFYING THE SAFETY AND SUITABILITY OF ANY AI CONTENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL Reciepie OR ITS OWNER BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE APP, THE SERVICE OR ANY MATERIALS, AI CONTENT, OR CONTENT ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT Reciepie HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF Reciepie AND ITS OWNER TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE APP OR SERVICE OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO Reciepie *THROUGH THE RESPECTIVE APP STORE* FOR ACCESS TO AND USE OF THE SERVICE IN THE 12 MONTHS PRIOR TO THE EVENT(S) OR CIRCUMSTANCE(S) GIVING RISE TO THE CLAIM; OR (B) $50 USD (OR THE EQUIVALENT IN LOCAL CURRENCY AS DETERMINED AT THE TIME OF JUDGEMENT).

12. Indemnification

You agree to defend, indemnify, and hold harmless Reciepie and its owner from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (a) your access to, use of, or alleged use of the App, Service or AI Content (including any commercial use); (b) your violation of these Terms, any applicable law or regulation, or the terms of any third-party service (including Google Gemini or the applicable App Store); (c) your violation of any third-party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (d) any disputes or issues between you and any third party (including the App Stores).

13. Termination

• By You: You may terminate your account and these Terms at any time by using the account deletion feature typically found within the App's settings menu or by contacting us at reciepie.app@gmail.com. Note that terminating your account with us does not automatically cancel active subscriptions managed through the App Stores; you must cancel those separately via your App Store account settings.
• By Us: We may suspend or terminate your access to and use of the Service (including the App), at our sole discretion, at any time and without notice or liability to you, including, without limitation, if you violate these Terms or if we cease offering the Service.
• Effect of Termination: Upon termination, your license to use the App and Service (including the AI Content license) will cease. Sections 5, 9, 10, 11, 12, 14, 15, and any other sections which by their nature should survive termination, will survive termination. Termination does not entitle you to a refund of any fees paid, except as potentially provided under the App Store's policies.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Slovenia, without regard to its conflict of law principles. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at reciepie.app@gmail.com. If a dispute is not resolved within 30 days of submission, any legal suit, action, or proceeding arising out of or related to these Terms or the App/Service shall be instituted exclusively in the federal or state courts located in Slovenia, and you waive any objection to venue or personal jurisdiction in such courts.

15. Changes to Terms

We reserve the right to modify these Terms at any time in our sole discretion. If we make material changes to these Terms, we will provide you with notice, such as by sending an email to the address associated with your account (if available), posting a notice within the App, or updating the "Effective Date" at the top of these Terms (which will be accessible within the App, e.g., in a 'Legal' or 'About' section). You should periodically review the most up-to-date version of the Terms accessible within the App. Your continued access or use of the App or Service after the effective date of the revised Terms constitutes your acceptance of the changes.
